Member Agreement

Communication Rules  

When utilizing the Member Center, Member agrees to follow these rules:

  1. Treat others with respect.
  2. Be open to learning from others and sharing your experience and knowledge.
  3. Use ALL CAPS sparingly and only to emphasize a point. (Using ALL CAPS is considered an online form of shouting.)
  4. Respect the integrity of certification exams. No specific exam questions may be posted.

Bowen EHS reserves the right to edit or remove content and forum posts that are deemed to violate these rules or any part of this agreement. Bowen EHS at its sole discretion may remove a participant from the Member Center for repeated rule violations.

Nondiscrimination

Bowen EHS does not discriminate or tolerate discrimination against participants on the basis of sex, gender identity, age, race, color, national origin, socioeconomic or ethnic background, religion, sexual orientation, or disability.

Limitation of Liability

The total liability of Bowen EHS for any and all claims arising out of this agreement and the services to be provided shall be limited to the total compensation actually received by Bowen EHS from Member in connection herewith.

Except as specifically provided herein, Bowen EHS disclaims any and all warranties of any kind, express or implied, including, but not limited to, warranties of performance, merchantability, fitness for a particular purpose, accuracy, and completeness. In no event shall Bowen EHS be liable to Member or anyone claiming through or for Member for any lost profits, commercial loss, loss of use, or any consequential, exemplary, incidental, indirect, or special damages.

Availability and Privacy of Records

Bowen EHS shall maintain participant records for at least seven (7) years. Copies of participant records will be provided within two (2) weeks following a request for release by the participant. Bowen EHS does not share any participant records with third parties without express consent from the participant.

Online Classroom System Requirements

Unless otherwise specifically noted in the membership or course description page, training provided by Bowen EHS is presented online over the Internet. Internet access and phone/data charges incurred by Member are the sole responsibility of Member.

Member must have adequate internet access, a device with an updated web browser, and the ability to view PDF files. Please refer to the computer requirements listed on this site for details. Bowen EHS is not responsible for Internet access of Member. 

Participant Complaint Procedure

Ownership of Content and Materials

Any and all content and materials created, supplied, included, or provided by Bowen EHS in connection with any course or membership shall remain the sole property of Bowen EHS. Without limiting the foregoing, the parties acknowledge and agree that any and all right, title, and interest (including copyrights and trademarks) in and to the content, lectures, and recordings as originally presented as well as any training, study, or other materials provided (whether in print, via email, or other formats) are and shall remain the sole property of Bowen EHS.

Member shall have a personal, nonexclusive, nontransferable, limited license to use and view such content and materials for purposes of preparing for and participating in the course or membership and for studying and reviewing for any examination. Member may make copies of any materials so provided by Bowen EHS for their own personal use only. Member acknowledges and agrees that Member has no right to, and that they shall not, sell, assign, license, convey, transfer, publish, or distribute training materials, content, or copies of recordings, or any parts thereof, to others without the express prior written consent of Bowen EHS.

Member hereby grants to Bowen EHS complete rights to store, broadcast, and sell content in which the Member participated or to which the Member may have made contributions. By posting content in the Member Center or in a classroom setting, Member grants Bowen EHS non-exclusive, royalty-free, and worldwide license to host and use such content.

Member agrees that any written materials, software, or other materials or items which may be provided to Member by Bowen EHS but which are not the property of Bowen EHS are and shall remain the property of the owner. Such items are being provided to Member with the permission or other agreement or authorization of the owner, and that Member's use of those items shall be subject to any applicable licenses, copyrights, or other agreements governing such items.

Enrollment

Bowen EHS agrees to enroll Member in the course(s) and memberships registered for by Member once registration fees have been paid.

Enrollment is personal to Member and may not be transferred without the prior written consent of Bowen EHS. Registrations may be transferred only as outlined below in Course Transfers.

Member agrees not to distribute training materials or copies of recorded lectures or other materials received to anyone other than Member without the express prior written consent of Bowen EHS. Member further agrees not to allow unauthorized persons to participate in the course in any manner or to view recorded lectures. Violation of this or any other provision shall be grounds for immediate termination of this agreement by Bowen EHS and forfeiture of any and all registration fees by Member.

Registration Fees

Member agrees to pay the registration fees. Registration fees cover only the cost of instruction and materials, if any, which Bowen EHS has specifically agreed to provide for the course.

Session Cancellation/Rescheduling Policy

Bowen EHS will make every reasonable effort to present sessions as scheduled. If a course session is not presented at the scheduled time for any reason, Bowen EHS will reschedule the session within four (4) weeks of its originally scheduled time. For other events, Bowen EHS will make every reasonable effort to reschedule.

Exam Review Course Transfer

Member shall not be permitted to transfer from one course to another. 

Online courses are provided directly to Member. Registration fees paid by a company for the benefit of an employee (Member) are transferable to a different employee at any time prior to the course start date with written notice from such company to Bowen EHS. Registration fees cannot be transferred after a course begins.

Exam Review Course Cancellation and Refund

Bowen EHS reserves the right to cancel an exam review course at any time with at least one (1) week notice prior to the start date of such course. In such case, a full refund of any registration fees previously paid by Member for that course will be issued to Member.

Member may cancel their exam review course registration and enrollment at any time by WRITTEN notice to Bowen EHS of Member's desire to cancel. Member shall be entitled to a refund based on the date Bowen EHS receives the written notice and the following schedule:

Twenty (20) days  to one (1) day before Full amount less two hundred dollar ($200) administration fee
Course Start Date to fourteen (14) days after Full amount less three hundred dollar ($300) administration fee
Fifteen(15) or more days after No refund

Professional Development Course Cancellation

Registration fees for Professional Development Courses (PDCs) cannot be refunded once purchased.

Membership Cancellation and Subscription Payment

No refunds shall be issued for paid memberships.

Member may pay for a membership using a recurring payment subscription. When Member cancels their subscription payment, only the renewal is cancelled. The current membership shall complete its current term and no refund shall be issued.

Stored payment methods shall be removed automatically ninety (90) days after expiration date of membership's term. Member may cancel their payment method at any time. Doing so while a membership is active will result in loss of membership access after the expiration date.

Return of Funds and Rebates

Any return of funds, including rebates, shall be returned to the entity that paid for the course.

Limited Guarantee - Exam Review Courses

Bowen EHS strives to provide Member with the information which they will need to understand the fundamental topics being studied or discussed. With respect to exam preparation and review courses, our goal is to prepare Member for the issues, questions, and topics pertinent to the exam in question. Bowen EHS will make its best efforts to present Member with the necessary information to prepare them for success on the relevant exam(s). However, Bowen EHS makes no representations, guaranties, or warranties regarding passage of any particular exam by any particular Member and hereby specifically disclaims any such representations, guaranties, or warranties except as expressly set forth herein.

Member may repeat the course for which they were enrolled (provided it is still being offered at such time) at no additional charge provided Member meets the following three conditions:

  1. Member must complete the course in which they are enrolled;
  2. Member must take the exam within twelve (12) months after live lectures are complete; and
  3. Member must provide a copy of their exam result notification to Bowen EHS

Entire Agreement

This Membership Agreement and the accompanying registration form constitute the entire agreement between the parties. No waiver, variation, or amendment of any term or condition hereof shall be effective without the written consent or approval of both parties. This agreement shall be governed by and subject to the laws of the State of North Carolina.

By completing the registration process, Member acknowledges that they have read and understand this Member Agreement and the accompanying registration form and that Member agrees to be bound by the terms hereof.
